Bookings

1. Introduction
1.1 This restaurant table booking service (the “System”) is operated by LiveRES Marketing Limited (referred to in this Agreement as “LiveRES” “we”, “us” or “our”).
1.2 The company details including registration number, registered address and VAT details can be viewed on the LiveRES website.
1.3 These are the terms and conditions which will govern your use of the System, which is provided to you by LiveRES on behalf of restaurants in the LiveRES system, either with whom you are booking a table (a “Restaurant”) or via the website of one of our third party booking partners (a “Booking Partner”).
1.4 By using the System you are deemed to have accepted these terms and conditions of use (the “User Terms”)

2. Your Booking
2.1 Please be advised that the dining services for which you book via your use of the System are provided to you by the Restaurant directly and not by LiveRES. Therefore by using the System to book a table at the Restaurant of your choice you are entering into a direct contract with that Restaurant and LiveRES is NOT a party to that contract.
2.2 In order to make any booking using our System you must have the legal capacity to do so and you must accept financial responsibility for all transactions made under your name. You must make sure that all the information you provide to us is true and accurate.
2.3 Booking a table at the Restaurant means you have to pay the Restaurant after you have eaten unless it is clearly indicated before you book that you have to prepay in advance or unless you make alternative arrangements directly with the restaurant to which LiveRES is not a party.
2.4 When you use the System to place a booking at the Restaurant you are making an offer to the Restaurant to accept your booking. Your booking is not complete and legally binding on the Restaurant until such time as you have received a confirmatory email from the Restaurant accepting your booking.
2.5 Please ensure that you arrive in plenty of time and bring a copy of your email booking confirmation. If you have prepaid in advance please also bring the credit/debit card you used to make the booking.
2.6 Because your contract is directly with the Restaurant any queries or concerns that you may have in connection with your restaurant table booking should be addressed directly to the Restaurant via the details set out in the confirmatory email.

3. Cancellations and No Shows
3.1 If you wish to cancel your booking you can use the hypertext link in the confirmation email or contact the Restaurant directly. Contact details can be found in the confirmation email.
3.2 Failure to attend the Restaurant at the reserved time may result in you being charged a “no-show” fee by the Restaurant. The decision whether to debit your card with a cancellation fee or “no-show” fee is entirely at the discretion of the Restaurant.
3.3 We reserve the right to cancel a booking, but this of course will be without any liability to you. We have, at any time for any reason without prior notification to you, the right to terminate or restrict, suspend or terminate your access to any or all of the System if we believe that you are misusing the System or if you are in breach of these User Terms.

4. Additional Terms
4.1 In addition to these User Terms, your use of a Restaurant or Booking Partner website and the other services and products provided by Restaurants and Booking Partners in the LiveRES System, may also be subject to any additional terms and conditions applied by restaurants and/or Booking Partners from time to time.
4.2 Those terms will be in addition to, and therefore not a replacement for, these User Terms. Please ensure that you read such additional terms and conditions before using the websites and/or purchasing the services and products provided by restaurants and Booking Partners.

5. Personal Information
5.1 To use our Service you are required to register certain information, including your name, email address and, in some instances, a password. Your registration details and any personal information supplied by you to us will be used by us in accordance with these User Terms and, where applicable, the terms of any privacy policy provided by the Restaurant and/or Booking Partner
5.2 You will receive emails and/or text messages related to the fulfilment of your booking and your use of the Service and we may use your personal information for that purpose. In addition, if selected by you at the time of making your booking, you may also receive information and special offers regarding future bookings, products or offers provided by the Restaurant and/or the Booking Partner from time to time.
5.3 You are responsible for ensuring that all personal data supplied by you to us is accurate and kept up to date. You must treat your password information as confidential and you must not disclose it to any other person.

6. Cookies
6.1 Similar to other commercial websites, our Service utilises a standard technology called “cookies” and web server logs to collect information about how our Service is used and to improve our Service.
6.2 Information gathered through cookies and web server logs may include the date and time of visits, the pages viewed, time spent using the Service, and the websites visited just before and just after your use of our Service.
6.3 Cookies do not allow us to gather any personal information about you and we do not generally store any personal information that you provided to us in your cookies.

7. Availability of the Service
7.1 Your access to the Service is permitted on a temporary basis and we reserve the right to withdraw or amend the Service without notice. We therefore exclude any liability to you for any interruption or lack of availability of the Service to the extent that we can legally do so.
7.2 You are solely responsible for making all technical and other arrangements necessary for access to the Service. You are also responsible for ensuring that all persons accessing the Service through your internet connection and account details are aware of these User Terms and comply with them.
7.3 We reserve the right to disable your access to our Service and, where applicable, any user ID or password issued to you at any time if, in our opinion, you have failed to comply with any of the provisions of this Agreement.

8. Restrictions on use
8.1 All copyright, database rights, trade marks, intellectual property rights and other proprietary rights subsisting in our Service and any content made available to you from the Service, shall remain our property or the property of our licensors. All such rights are expressly reserved.
You agree not to use our System in such a way as to cause the whole or part of our System to be interrupted, damaged, rendered less effective or be otherwise impaired or in any way contrary to applicable law.

9. Security
9.1 We maintain the highest standards of security, however the transmission of information via the internet is never completely secure. So, whilst we will do our best to protect your personal information, we cannot ensure the security of your data transmitted to our Service. Any transmission is at your own risk.
9.2 Once we have received your personal information we will use strict procedures and security features to prevent unauthorised access.

10. Our liability
10.1 Nothing in these User Terms shall exclude our liability for death or personal injury arising through negligence or for fraud.
10.2 We do not accept responsibility for any loss, damages or costs suffered or incurred by you arising from viruses or contaminants contracted by you or your machine via accessing or using our System.
10.3 To the maximum extent allowed by applicable law we exclude all liability and responsibility arising from any reliance placed on any content available from the System. You bear the entire risk of the completeness, accuracy or usefulness of any content accessed on our System.
10.4 To the maximum extent allowed by applicable law we exclude all liability and responsibility arising from your use of:
• the services and products provided by the Restaurant and/or Booking Partners; and
• the Restaurant’s and/or Booking Partner’s failure to supply such services or products, whether in whole or in part.
10.5 To the maximum extent allowed by applicable law, we expressly disclaim all warranties and conditions, express or implied, including, but not limited to, implied warranties and conditions of satisfactory quality and fitness for a particular purpose. You will not hold us responsible for any damages that result from you accessing (including any software or systems you use to access) our Service, but not limited to, damage to any computer, software or system or portable devices you use to access the same.
10.6 Under no circumstances shall we be liable to you for any consequential, incidental or special damages or for loss of business profits, business interruption, loss of business information, loss of data or loss of any benefit arising out of your use or inability to use our Services.

11. Changes
11.1 We reserve the right at any time to vary these User Terms. Your continued use of our System following any such variation shall constitute your acceptance of such changes.

12. Jurisdiction and applicable law
12.1 The English Courts will have exclusive jurisdiction over any claim arising from or related to your use of the Service. English Law will apply to these User Terms.

13. Trade Marks
13.1 LiveRES and the LiveRES System are either registered or unregistered trademarks of LiveRES Marketing Limited. All other trademarks referred to on our System are owned by their respective owners. No permission is given for their use by any person and such use may constitute an infringement of our rights or the rights of the applicable owner.

Venue Hire & Group Booking

Availability of group bookings, private rooms, the capacity and facilities within these and the package options we can offer vary by restaurant. Information given on the website is correct at the time of writing but is subject to change. Please contact a restaurant using the online enquiry form or by telephone in order to confirm details and find out which packages are available to meet your requirements.

Adult Pizza Making Parties

1. Introduction
1.1 Adult Pizza Making Parties cost £27.95 per person per party for a minimum of 8 guests. This includes a dedicated party host, a glass of Prosecco (soft drink alternatives available) and dough balls on arrival, your pizza ingredients and use of the Party room for 2.5 hours.

2. Payment terms and deposits:
2.1 PizzaExpress operates a deposits policy of £5 per person per party for pizza making party bookings. Your booking is not confirmed until we have received your non-refundable deposit of £5 per head.
2.2 Deposits are taken by credit card, debit card, or cash. We accept all major credit cards.
2.3 Through payment of this deposit you are deemed to have accepted our Party Terms and Conditions. We reserve the right to decline any party booking request. Your party balance must be settled in full on the day of the party.

3. Minimum number policy:
3.1 PizzaExpress operates a minimum number of 8 adults for a party. You may book for fewer than 8 attendees, but please bear in mind that you will be charged for 8 as a minimum.

4. Cancellations Policy:
4.1 PizzaExpress operates a cancellations policy for pizza making party bookings. This policy is as follows:
a) Customers will be asked to confirm the number of guests attending 48 hours before the party, and this number is the number of guests that you will be charged for on the day, even if fewer guests turn up.
b) You will receive your £5 per person deposit back in full for any guests confirmed 48 hours prior who are not present on the day.
c) If you cancel less than 48hrs before, or fail to turn up, you will lose your entire deposit.
4.2 Confirmation of party numbers or cancellation of the party must be done by emailing the restaurant manager on the same address from which you received your booking confirmation email.

5. General terms and conditions:
5.1 Special dietary requirements and any other pertinent information should be discussed with us at the time of booking or payment of your balance. We will endeavour to accommodate any special requirements which have been discussed with us, but there may be an additional charge.
5.2 Personal possessions left in the party room are left at your own risk. We will not accept responsibility for the loss of or damage to any personal possessions on our premises, or for any personal injury arising other than through our negligence or that of our staff.
5.3 Pizza making parties are not valid in conjunction with any promotions. You cannot use Tesco or Nectar vouchers to pay for pizza making parties. Party bookings availability differ by restaurant – please ring the restaurant of your choice and the manager will advise of their availability.

Kids Pizza Making Parties

1. Introduction
1.1 Kids Pizza Making Parties cost £14.95 per child per party for a minimum of 8 guests. This includes party invitations, a dedicated party host, your pizza ingredients, all-you-can-drink squash, gelato for each child, and use of the Party room for up to 2 hours.
1.2 There is a minimum age of 4 years for party guests.

2. Payment terms and deposits:
2.1 PizzaExpress operates a deposits policy of £5 per person per party for pizza making party bookings. Your booking is not confirmed until we have received your non-refundable deposit of £5 per head.

5.1 An appropriate level of adult supervision must be present at all pizza making parties. This supervision is as follows:
Ages 4-5 – 1 parent for every 4 children
Ages 6-7 – 1 parent for every 6 children
Ages 8-11 – 1 parent for every 10 children
5.2 Whilst the dedicated party host will be on hand to entertain the children throughout the party, parents must be nearby at all times and must step in to help any children go to the toilet or wash their hands.

6. General terms and conditions:
6.1 Special dietary requirements and any other pertinent information should be discussed with us at the time of booking or payment of your balance. We will endeavour to accommodate any special requirements which have been discussed with us, but there may be an additional charge.

We may also report aggregate information to our advertisers. This is statistical data about browsing actions and patterns and does not identify you as an individual.

3. What Information do we collect on our App?
3.1 When using our App, you may provide us with the following Information:
a) your name and contact details (email address and mobile telephone number), if you use the App to book a table at one of our restaurants;
b) further information (mobile phone number, date of birth, favourite restaurants, details about other members of your family who might be interested in our services, if you use the App to register as a registered user or subscribe to receive updates or offers from us. To become a registered user you must provide us with your name, address, email address, and date of birth, but you may also provide us with additional information if you choose to do so;
c) information which allows us to identify your credit, debit or PayPal account details to complete a transaction with you, should you elect to pay for your takeaway or pay your restaurant bill using a PayPal account via the App;
d) your physical location, where you have agreed to it being used for the ‘Find a Restaurant’ feature on the App; and
e) other Information that may be provided by you when adding content to our App, or to our social network pages such as Facebook.

4. Cookies
4.1 Similar to other commercial websites, our Website uses a technology called "cookies" and web server logs to collect information about how our Website is used.
